Legal Question in Employment Law in Georgia

Non compete agreement

I signed a non compete agreement when I went to work with my employer. The gentleman who owned the company when I went to work recently sold the company. It is my understanding that the new owners did not form a new corporation. Am I still bound to this agreement?

Re: Non compete agreement

It depends on the exact terms of the agreement. Most good non-competes will have language stating that any successor will hold the same rights.

Re: Non compete agreement

Contracts do not normally go away when a company is sold - they are often a valuable asset for the purchaser. Since you provide no information about the transaction (only what you heard did not happen), and obviously no one here has the contract, no one here can tell you whether your contract is, or was ever, valid.
