Non-Payment of Promised Bonus

My position was being eliminated. Employer assumed I would take a new job within the company in a different city/state. I voluntarily left the company before severence agreement and before end of fiscal year. When bonuses were paid, I did not get pro-rated bonus, reason: was not on the books as of 12/31/2005. I lived/worked in Florida, company headquarters in Atlanta, Georgia

There is no way to answer without knowing the terms of the bonus. A bonus is almost always entirely based on the terms and conditions set by the employer. It is quite common to limit bonuses to people on staff when they are paid, since bonuses are often intended to maintain employees and morale. You may want to re-post the question with more specifics about the "promise" of the bonus, and the general terms of the bonus. The burden would be on you to show that you were contractually entitled to the bonus even though you left before it was paid.
