Legal Question in Employment Law in Georgia

I am the owner of a small business who recently fired a 1099 employee. This employee has kept equipment and tools that belong to the company. I know that I can file theft by recieving charges against this employee ... I believe. What would be the best way to approach this scenario ensuring that my company is protected? Also should I file in the city/county of the business or where the ex-employee resides?

If you are paying the person via a 1099, he is not an employee. If he should have been paid as an employee, keep that in mind when you proceed; he may make a claim with the State. You have the option to seek an arrest warrant where he lives and/or sue to get the property back.
