Penalty
We have an alarm system in our office. We have had numerous employees set it off which has caused us to be fined by the county. Can we institute a policy whereby we can fine an emplyoyee if they set off the alarm? Basically, We'd like to pass the cost of the county fine off to the offending employee.

Yes, you can, but any such policy should be clearly conveyed and in writing. However, do you fine employees for other conduct that costs the company money? Do you rely on those same employees to set the alarm and protect the property? Do the employees have access to funds or goods to "recoup" that fine (ie, steal from you)? These are not necessarily relevant to a legal issue, but you should consider the ramifications of policies like this.

Just to add on to what Scott said, be careful if any fines reduce an employee's pay below minimum wage for the pay period during which the pay period occurs. You should also have a separate written document to be signed by the employees (preferably before any fines are imposed) to acknowledge the potential fines.
