Legal Question in Employment Law in Georgia
policy or compliance violation
I am being placed on Final warning by my employer for actions I did not commit. In addition, there is no policy/ violation HR resource outlet provided by my employer to the employee's that indicates I have broken any of these policies I'm being accused of. There is lack of training on policy and compliance in my field(Pharmaceuticals) which has been acknowledged by District and Regional Managers publicly. Plus, several employee's and District Mangers have participated in these actions I'm being held accountable for with NO documentation issued to them. My company is going through a restructuring and if this warning is placed in my file, I feel it will be grounds for my termination. I have worked for this company for over 8yrs and have NEVER received a bad review, plus have won several awards including Rep of the Year. I have presented my proof of facts that clearly show no wrong doing on my part, but this is still being placed in my file. i want to know my rights regarding these issues and what legal action I can take.

The standard response is that employment in Georgia is "at will," and an employee can be filed for any reason, or no reason at all. The primary exceptions are where there is a contract stating otherwise, or the termination is for unlawful discrimination. In some limited cases, HR manuals MIGHT confer additional contractual rights. There is no general "right" to a job. The flip side - employees generally have the same right to quit for any or no reason. All we can get from your post is that you have a dispute with the employer over something, and you disagree with them. That is generally not going to alter the "at will" employment, and the threat of a lawsuit is often going to assure the outcome. If you think this rises to some kind of contractual violation on their end, gather all HR manuals, etc., and call an employment lawyer.
