Legal Question in Employment Law in Georgia

Position Demotion

From Oct. 95 until Dec. 99' I was manager of a distribution warehouse. In 98' a new operations manager was hired (my supervisor)He never gave me a formal review but did verbally, repeatedly, laud my performance. He also secured for me a substantial raise. In Dec. 99 he informed me that he had hired a new warehouse manager, and that I would now be the deputy Mgr. I would not lose pay and would keep my Company vehicle. I was also told not to expect a raise any time in the near future. This was completely out of the blue, and no rationale' for the change was made. My replacement is an old friend of the operations manager who had just retired from the Army. He has no qualification for the position other than the fact that he is a former staff officer having worked for the the operations manager in a previous assignment. Additionally- I have recently discovered that my new boss was incarserated at Ft. Leavenworth for sexual activity with a minor.

I am being squeezed out of a job that I had planned on holding for a long time.

Do I have any legal footing in this issue?

Re: Position Demotion

Georgia is an at-will state, which means that an employer may promote whoever they want for a good reason, a bad reason or no reason at all as long as it is not for a discriminatory reason. Unfortunately in your situation, even if the hiring of an unqualified person above you was purely the result of favoritism, you would not have legal action. If there were some discriminatory reason, you might have a claim. Check with a local attorney or the EEOC if you are unsure.
