Legal Question in Employment Law in Georgia
Previous employer giving falsely negative reference.
I have a strong suspicion my previous employer (whom I've had problems with) has been giving me a false negative reference. Even as far as saying I was terminated, when actually I quit. I am confident I can prove all of this, but not sure if it is worth my time. I believe this is slander, am I right? At this time, I am still looking for work, but keep getting that ''We filled the position'', or ''we're not hiring'' when I know they are. I need help, bad. Thank you for your time.

Re: Previous employer giving falsely negative reference.
Yes, if they are saying negative things about you that aren't true, and that is costing you jobs, that could be something you could sue them for. However, "suspicion" they are doing it is not enough. You will have to be able to prove they are saying it, and that it cost you possible jobs, all by a "preponderance of the evidence". Those are two tough hurdles.
