Legal Question in Employment Law in Georgia
Hello, I recently started a part time job and I had to submit a background check which shows where I was arrested for underage drinking 7 years ago but the case was dissmissed. My boss has just now looked at the background check and I'm affraid he might fire me. Can he do this? and if he ask me to tell him about what happened am i obligated to tell him? what do I say if I dont want to talk about it and am not obligated to? Thank you very much for your help

There is no general right to a job, and absent unlawful discrimination (age, race, etc.) or a contract, an employee can be terminated for any or no reason. Further, you have no "obligation" to discuss it with him but he is also under no obligation to continue your employment if you refuse to discuss it. If you do get asked about it by him or other employers, you will find that being honest about it will get you much further than an attitude of hiding it or refusing to discuss it. If you are a good employee and it was an isolated incident 7 years ago, you are probably OK. If you have other issues, or have an attitude if asked about it, employers are much more likely to take action.
