Legal Question in Employment Law in Georgia
Do I have any rights?
I would like to knwo if I have any rights. On August 8,2006 I was terminated from my job for attendance. On July 16,2006 I became very ill from what they thought was food poison, not able to kept anything on my stomach. I had to have an IV on Thursday of that week. The next 3 weeks I was going back and forth for MRI, Ultrasounds and Scans. I even had to have an Upper Endoscopy procedure done. And was told that I had red spots on my stomach. In the meantime the pain is still hear. I was terminated and received a letter stating that ORkIN had stated that I had follwed all procedures in notifying the office on previous absents. I was approved for my unemployment stating that it was not my fault that I became sick. Now I have received a letter stating that ORKIN has filed an appeal against my unemployment after stating that I was able to received. On my termination letter it states that I am eligble for re-hire. Do I have any course that I can take against the company for this. Since it was not my fault that I became sick. I had used my vacation and sick days on some days that the pain was just too much. Other times on 3 different days, I went in and sat at my desk and cried from the pain and no one never asked what was wrong.

We do not know the basis for the position the employer is taking. You will have the right to assert your position in paperwork, or at a hearing. Make sure you read and comply with all deadlines, meetings and hearings.
