Something Rotten in the Federal Government
I am a Federal employee working for the military. In 2002, my supervisor assaulted me and then demanded that I leave the premises immediately. An Army Major was an eyewitness to the incident. (A Master Sergeant testified at the OCI FFC that she was present, but I have documentation to prove she wasn't.) Since I had an ongoing EEO(ADA)complaint against my supervisor, I filed a retaliation complaint.The pre-hearing conference, with the attorneys and the Judge took place on 6/21/04. During this conference, the JAG attorney told the Judge that a settlement offer would be made (to me) by 6/30/04; however, that never happened. The hearing was to take place on 7/20/04. Two days before the hearing (7/16/04), the Judge contacted my attorney to say that the hearing is postponed. About a week and a half later, I receive a ''Decision Without a Hearing'' in favor of the Agency from the EEOC. My attorney never contacted me about the ''Decision.'' My question is twofold. I understand that I am able to appeal the Judge's decision; however, I am suspicious why the Judge didn't make a Decision during the Pre-Hearing Conference if he was going to do so. The second question is: I paid my attorney over $33K -- is there any recourse for me on this?

It sounds like you have a somewhat complex case. It is hard to say why judges do what they do; there are probably more facts out there of which you are not aware. There might be a recourse against your attorney if it can be shown that (s)he fell below the standard.
