Severance Pay dependent on Non-Compete Agreement

Can an employer lay off an employee and restrict the payment of severance pay to the stipulation of signing a non-compete agreement.

Yes. Severance pay is not required. It is payment in exchange for signing certain documents, including a non-compete.
