right to sue letter
i filed with the eeoc 4 months ago, i am finally going to mediation. if there is no meeting of the minds the eeoc will start investigation. The eeoc here seems to be pro business and doesn't seem to investigate fairly and i feel that i may not be able to recieve a right to sue letter. I can still sue the company for sexual harrassment and sex discrimination or not??? can i persue them in civil court?

You will always be able to get a right to sue letter from the EEOC if the case is not settled during mediation. You may get a determination that the EEOC did or did not find evidence to support the charge of discrimination, or the EEOC may simply issue the letter without a determination. To get a right to sue letter, simply write to the EEOC (presumably after the mediation) and ask for one. After you receive your right to sue, you will only have 90 days in which to file suit in federal court. In most circumstances, federal court is the only place in which you can sue.
