Legal Question in Employment Law in Georgia

Tattoos in the Workplace

My husband is a manager at a quick lube. He just recently got a tattoo. His boss did not have a policy against it at the time, but he is now trying to implement it. Is my husband at risk of losing his job? Does the ''Granfather Clause'' apply here?

Re: Tattoos in the Workplace

Georgia is very much an "employment at will" state, meaning that unless he has an employment contract which protects him (unlikely at a quick lube), he can be fired for any reason or no reason. The only protection here would be for unlawful discrimination due to race, color, creed, gender, religion, etc., and having a tatoo is not a legally protected category. Nor is there any "grandfather clause" in the law protecting an employee's right to have a tatoo just because there was no stated policy against it at the time he got it. My practical suggestion here is that if his boss is so aggrieved that he would consider firing your husband over this, tell your husband to tell the boss if he doesn't like employees sporting tatoos, he will wear clothing which hides it.
