Legal Question in Employment Law in Georgia
terminated or fired
On Friday Oct. 20th I called my supervisor and told her I wanted to give my notice. I told her I would like my last day to be Oct.31st. She asked to meet with me ''and talk me out of it'' I meet with her after the business day concluded and we couldn't come to an agreement. When I went to work today I was told to leave. Did I get fired or terminated? I beleive they didn't want to pay some benifits I would have received by staying until Oct. 31st?
Thanks
David

Re: terminated or fired
From your post you were neither fired, nor terminated. You quit. When a person quits, they have no right to dictate terms, last days, etc. When people "give notice" that simply means they quit. Whether or not the person works beyond that minute is merely a courtesy agreed on by both parties. One should never quit a job (or "give notice")before they are ready to leave. That said, there are some examples where an employee may have a claim, such as when he/she expresses a desire to retire the day of the 30th anniversary to get full retirement benefits and the company tries to say they quit. Those are the exception to the rule. Quitting before a bonus, another vacation day, etc. are not the same. See a lawyer if you think you may not fit into these general rules.
