Legal Question in Employment Law in Georgia

terminated during garnishment

I'm a trucker that gets home every weekend well at least I did. I was terminated for taken the truck home. On the trip I lost the keys to my car and drove the truck home to spend the weekend and get my extra set. But when I had no car I took the truck home weekly with permission. I know that when drivers go home and management finds out about it at the very most they take a fee out of there check. I was never given this opportunity and I did not try to deceive them I called and left a message on the voice mail at 0400. Prior to this time my check was garnishered. And then termination, then denided unemployment and now they have called to try to rehire me. What is going on?

Re: terminated during garnishment

Basically, unless you were protected by a collective bargaining agreement with a union, you can pretty much be fired for any reason other than illegal ones, such as race discrimination. This does not sound like an illegal reason. You were denied unemployment probably because the employer successfully contended you were terminated for misconduct.

My practical advice here is seriously consider accepting their rehire offer. If after all this they still want you back and have let you know it on their own initiative, then it sounds like they are willing to forgive and forget and feel they have made their point, whatever it is. This is not a situation where I would expect you to be harassed if you accepted. In fact, this is unusual and may hint at the real possibility of a better working relationship next time around. Next time something like this happens, call your dispatcher and try to get clearance from proper authority to take the truck home.
