termination of employment

I have an employee that is out of work for a non work related back injury. He is going to pain management and on several narcotic drugs. We are a very small construction company and are concerned about him being on the jobsite taking these types of prescrition drugs. Can we refuse to have him return to work until off of the medications completely. What are my options as a small business owner.

Yes, as long as you have a reasonable basis for not allowing him to come back to work, which it certainly sounds like you have. You probably wouldn't be required to retain him as an employee either.
