Terminations

I was employed by this company and I was having some medical issues which caused me to miss time at work. They gave me a write-up last Thursday and recommended I take short-term LOA and apply for short term disability. I requested a LOA and this Tuesday they terminated me. I was asked to resign and they would give me 2 months of severance. I have not sent a resignation nor have I gotten my severance contract package. Does this seem to be in violation of some kind of law? Maybe discrimination? They would probably use the write-up as an excuse but since that I have missed no time or been late. The write-up stated that if that continued they would have to consider where I would fit in the company.

You should consult with a labor and employment lawyer immediately. Do not discuss the matter with anyone else prior to doing so.

If your ER has more than 50 EE's and you have worked for the ER for a year then you would be covered by the FMLA. Potentially the ER's actions are violations of the FMLA and other federal statutes and you should contact an employment attorney like myself to review your situation.
