Legal Question in Employment Law in Georgia
Transportation of employees in mgmt personal vehicles
My employer requires me as a member of mgmt to transport employees in my personal vehicle to medical facilities in case of minor injuries or for post accident drug screens. The associate must ''clock out'' before leaving work. in case of an auto accident causing injury or death to the employee can I or my estate(in the case of my death) be sued? What is my potential liability. What is my company responsible for?

Re: Transportation of employees in mgmt personal vehicles
If you are driving your vehicle (or even if you drive a company vehicle or someone else's vehicle), you can certainly be sued. You are responsible for your actions and negligence. The company may or may not be liable, but it is a safe bet that if you were in the scope of your employment they would probably be included a defendant to add another pocket. There is no way to speculate about potential liability of either of you in any particular circumstance. It is definitely something you want to consider when reviewing your insurance, and not a bad idea to inquire about the company's insurance.
