Vacation Time

Is it legal for a private (church daycare) to take your vaction time when you have been out sick. I understand that you can request them to use your days so you would not loose pay. But can they just use them with out asking you. Ex. One daycare worker was out sick, she did not want to use any vacation days. She would just be short on that check. When she got her check, they had taken that amount of time out of her vacation time. Is that lega?

Your question could be clearer, so I am assuming that she did get paid, but they charged her vacation for it. There's no clear law on this. It is a question of contract and employer policy. But, let me give her some terribly practical advice. Rather than have a feud with the employer over this, just take the money for the one day and put it in the bank and earn interest on it. Same thing, plus interest. Save it for that vacation later.
