Legal Question in Employment Law in Georgia

withholding of pay for damages

Can an employer withhold pay from your paycheck for replacing something that you accidentally messed up on? For about 8 doors that had to be resanded and a door replaced that I mis-drilled, that I dont think he replaced, he deducted $212.00 from my paycheck without my consent. I dont think that he can deduct from your paycheck unless he has your approval in writing or court-ordered.

Re: withholding of pay for damages

The answer depends on a couple of things. If there is an employment agreement, the terms might address the issue. Otherwise, it is possible that your employer properly withheld some amounts. However, you can still fight it after the fact.
