Withholding of paycheck

Can an employer withhold a paycheck based upon an email exchange (not a signed agreement) where he stated amongst other things at the bottom that if I terminated within a year I owe them for what they paid the recruiter? I sent email response that I agreed with his email but he advised he would have me sign an agreement when I started. It was never mentioned again until I gave my 2 weeks notice. Now he's suggesting that I work the entire month of September without 2 paychecks and we'll call it even.

With some exceptions, contracts do not generally have to be in writing and emails often constitute pretty good evidence of a contract.
