Legal Question in Employment Law in Georgia
I work for a large well known auto repair company. We were just informed that they are bringing back a policy called "Black Flag." I am paid flag hours, essentially I get paid a certain amount per job (ie. an alignment pays 1.4 hours). By bringing back "Black Flag" we have been told that if a customer brings a car back to the repair shop claiming the mechanic messed up and the issue is not fixed we lose our pay for that job. The details are murky but when a customer brings a car back after a repair for the same thing a ticket called "Quality Assurance Check" is started. We have been told that if we are not the mechanic that does the "Quality Assurance Check" we automatically lose the pay that we already received for repairing that vehicle. If we do the "Quality Assurance Check we will not be paid for the time it takes to do it. If the problem exists as the customer stated we will also lose the pay we have already received for completing the job. This is a no exception policy. This means if a customer has an alignment done on Friday and they drive for 2 weeks, go over a ton of potholes, and come back to say the alignment is out of whack again I will lose the pay I have already received; it will be taken out of my paycheck the week the car returned. I want to know if this is legal.
On another note, I was asked to sign a form stating that I give up all rights to sue my company for anything related to my hiring, firing, discrimination, etc while with the company. I am mandated to use mediation of their choosing. I have been told that I will lose my job if I do not sign this form. I want to know if this is legal as well.

I would suggest that you (1) see an employment lawyer and show him the paperwork before signing, and (2) seriously consider working for a legitimate company rather than an obviously bad employer that does not want to keep its employees.
