I hate to say this, but it all depends on what is on the lease and how much each contributed to the deposit. If one person put in 70% and the other 30%, under normally circumstances, it should be returned that way. However, the facts in your case may change that distribution.

Easy solution - the two people act like responsible adults and split the money based on how it was initially paid. The landlord is not responsible for that unless the lease states otherwise.
