Legal Question in Landlord & Tenant Law in Georgia

answer to eviction

I was served an eviction notice and was told I have seven days to respond, in writing, with an answer. My husband and I built our home 13 years ago on land that was supposed to be a wedding gift from my in-laws, but was never put in our names. I have countless reciepts showing we built the house and land tax reciepts we have paid every year. I realize we need an attorney, but I only have until this Tuesday to respond. Could someone please tell me the proper way to respond? I know I will have to retain an attorney before we go to court, but this is kind of sudden and I need to figure out where I stand financially. Thank you for taking the time to read this.

Re: answer to eviction

The best advise is that you need to get a lawyer now. We cannot specifically advise you on how to respond to a lawsuit we know nothing about.

Re: answer to eviction

I agree with Mr. Riddle. Although I will add that in magistrate court, you don't need to file a detailed response. You basically just need to state that what they are alleging is not accurate and the reason. However, you may also have some counter or cross claims you would need to include in your answer, which would best be handled by a local attorney.
