If an apartment complex fails to sign the lease is it still a binding contract

Yes and maybe. Yes, you would still have at least a verbal lease agreement to pay rent. Maybe in the sense that as long as the apartment complex intends to be bound by the written, it would be enforceable against you since you signed it.
