Legal Question in Landlord & Tenant Law in Georgia

Dipossessory Warrant - After I moved!

Signed 12-month lease in 8/2006. Lease was set to expire on 7/31/07. We live in Dekalb County, GA.

- Serious repairs were never addressed

- Management lost our extra keys and never replaced the lock

- Unit was robbed, onsite security told us of several recent break-ins (we knew nothing about them)

- Doorframe never properly fixed (after robbery)

- We wrote corp. demanding attention to repairs and security concerns

- Wrote informing of our intent to break lease on 7/1

- Mid-August, we received a dispossessory warrant notice. However, it was past the court date

What can we do?

Re: Dipossessory Warrant - After I moved!

You need to notify the magistrate court in DeKalb county immediately and explain what happened and see if you can get new hearing set. Since you missed the court date and didn't answer the dispossessory, the landlord can now request a writ of possession and have you evicted.
