Legal Question in Landlord & Tenant Law in Georgia

Evicting Tenants that are in arrears prior to Purchase Date

I have tenants on a lease purchase agreement. The orginal agreement stated that the purchaers of the property were to pay $6000 down by August 1, 2006.

They fell over $5000 behind. They still owe $500 dollars of the orginal $6000. I have allowed them to try and catch up. They have failed on four promissary notes and bounced one rental check which they did make good with cash. They must purchase the home by July 1, 2006 or the property reverts to me. I need to move on evicting them as I must refinance the home by August 1, 2006. I have the Form to be served by the sheriff and the form from the Magistrate court (Dispossessory Affidavit. How would you suggest I proceed?

That's not a question that would feasible to answer in this type of forum. If you need legal help, I would strongly suggest obtaining local counsel familiar with landlord-tenant law. If you decide against hiring an attorney, the clerk of the magistrate court often offers some guidance, but cant offer legal advice.

If you would like to discuss any issues further, please feel free to contact my office. My contact information is below. Thank you.

The foregoing is general information only, not specific legal advice. No attorney/client relation has been created or should be implied.
