Legal Question in Landlord & Tenant Law in Georgia

Eviction

I lost my job last year and was evicted from my apt. Oct. 2005, and I was not given back my deposit. The apt. lease was signed by myself and (ex)boyfriend. Now I am getting collection letters for the rent for Oct. Since I was evicted does the Apt. complex have a legal right to turn me into collections? Do they have a right to turn me into the credit bur. ? And last, if I paid 1/2 can they force my ex-boyfriend to pay the bal. and keep this from going on my credit history? Thank you

Re: Eviction

Getting evicted is certainly not a waiver of their damages. If anything, it increases what you owe under the lease (such as termination fees), attorneys fees, etc. Yes, they can collect and yes, getting evicted for nonpayment is relevant to your credit report. Most leases also make all tenants liable for the entire amount, so they can collect the entire amount from either one.
