eviction

i rented my home to my sister and her boyfriend. they caused a fire in the kitchen. the house was cleaned by professional cleaners. they have not paid any rent for 3 months. i had eviction papers served. they are now saying that due to kids getting sick from the soot 3 months later that they are taking me to court. although they have continued to live there. the house is liveable. just burned hood over stove and cabinets. can they do this and will they still be evicted

Re: eviction

The eviction is a separate issue from the personal injury allegedly caused by the soot. They, of course, have the right to sue for any injuries, but you would still have the right to evict them for failure to pay rent. There may be some issue with whether or not they would have to bring their suit against you in the same proceeding as the eviction, but it doesn't sound like it form your posting.
