I was illegally evicted on new years day, given 30 min to get things for me and 2 kids, now the rest of my things are still there, do I have to sue her? the sheriff told me if she doesnt agree to let me get my property then I would have to take her to court

If you were evicted by the sheriff, that means you lost a court case. When the sheriff arrives, there is no more "notice." The notice comes in having the court case, losing, and having a dispossessory entered that puts you on notice that the sheriff could come any time. In most cases, that means possessions and property are all piled up by the street so if that did not happen it is probably a good thing. You can work with the landlord, or face the same risk later. A lawsuit might hasten the landlord to put your stuff on the street.
