my sister rented her house and the people do not pay by due date per the lease. She gave them her account number to make the deposit. They pay bits and pieces whenever they want. The rent is $1100. So far they paid $700 for September and didn't pay they rest including $100 late payment fee. They sent an e-mail saying they'll pay October's rent on 10/21 plus the penality and the remaining ballance for last month. She wants them to evacuate. What shall she do? Currently she is out of the country taking care of very sick mother.

Can she change her lease and send them a copy to sign while she is outside of the country. She doesn't them to make a depost to the account.

The first step will be to send a demand for full payment of all back rent and any fees/penalties along with a deadline to pay or vacate the property. If the tenant does not pay the amounts and does not vacate by that date, the landlord can file a dispossessory in order to get back possession of the property.

Regarding changing the lease, the landlord cannot force the tenants to sign a new one, and if they refuse, they terms of the old one will apply.
