Legal Question in Landlord & Tenant Law in Georgia

Landlord's brother tries to strong arm my family

A writ of possession has been issued. The sheriff is scheduled to come out on June 12th. The landlord's brother and five other men physically attempted to remove our property and beat up my children while I was not home. The police said that it is not neccessary for him to wait for the sheriff once the writ is issued. Is this true? How can I file crimminal and civil suits against the landlord, her brother and the other men that were involved? The men told the police that they won't be back until the 12th, but what if they do come back? I am trying my best to leave as soon as possible.

You make a criminal complaint with the police. As for the writ of possession, the 2 weeks you have from now will be considered plenty of time for you to be out. The longer you try to stay there, the reality is that the more your claims will be questioned and the more incidents will occur because the landlord wants his property back. People come up with excuses every day to try to stay, including more and more claims against the landlord. The best thing you can do is get out, keep your children safe, and then pursue whatever claims you may have.
