lease civil suit
I defaulted on a lease and the landlord sued me for rest of rent for three years and I countersued for $504,000 claiming discrimination and lack of security.As soon as the countersuit was filed, the landlord urged for a mutual dismissal of both cases with prejudice. The question is can the lanlord pursue the liquidated damages using another avenue such as collection agency or has he lost the right the pursue the liquidated damages for ever?

The settlement agreement should cover all legal and/or collection actions regarding all damages stemming from the lease. In other words, once the agreement is finalized, they can�t pursue any action against you. Have an attorney either draft or review the settlement agreement to make sure that it covers these contingencies.
