Legal Question in Landlord & Tenant Law in Georgia
non payment of rent
I rented a house for 9 years, now my landlord is not returning my security deposit. She says that my deposit was refunded in march of 2000, because a rent check from that month was never cashed, she provided me with a copy of that non-cashed check. I reviewed my records and found that I was charged a stop pymt fee during march 2000 by my bank and there was another check cashed near the end of the month for the same amount of march 2000 rent. This check number is only 6 check numbers away from the non-cashed check. After reveiw of other months bank statements the rent checks usually fall appox 20-25 check numbers apart from each month. Due to the age of these checks I cannot get copies from the bank, only the bank statements. I do not recall agreeing to using my security deposit for that months rent--espeically since I was planning on continuing to live there. I think I would remember having the etxra money. How do I get my deposit back???

Re: non payment of rent
If the tenancy ended back in 2000, it is probably too late to try and get your deposit back. Otherwise, you may file suit for the money in the county where the house is/was located.
