Legal Question in Landlord & Tenant Law in Georgia

removing a live in boyfriend from my house

My boyfriend and his kids moved in with me about 10 months ago. We have ended the relationship but he says that I have to give him a 30 days written notice to get out. However, he has refused to pay his portion of the mortgage that was due February 1st and other bills that are currently do or past due. Do I have to allow him 30 days to get out? If not, how can I have him removed? His name is not on the mortgage nor do we have a signed renters agreement.

Re: removing a live in boyfriend from my house

If paying a portion of the mortgage and the bills are terms of his tenancy with you, then you do not need to provide any particular prior notice due to his breach of the lease agreement. You simply have to demand that he leave (ideally in writing), and if he does not leave by whatever deadline you set, you can file a dispossessory (eviction) action. However, if paying the mortgage/bills was not a part of it, you would have to provide 60 days' notice.
