Can I get rent my money back?

After leasing an apartment , I am being harrassed by my neighbors. Management is refusing to take serious action. I've been in the apt for only 6 months. management told me that I can break my lease w/o penalties., but until that day come, my neoghbors below me continues to harass me late at night. I filed a report with my PD, but was told that since they were not committing a crime, they cant do anything. Q: Can I bring a cause of action against my neighbors and management asking for all the rent money refunded to me and for the cost of everything that I've put out because the neighbor below has breached a clause in the lease which speaks of no harrassment or intimidation?

They have offered to let you go w/out penalty. Thus, the longer you stay the more it will appear as though you are accepting the situation (whatver that may be - you did not provide any facts). It is not reasonable to assume that anywhere near all your rent money would be refunded to you. You had the benefit of a place to stay for 6 months, and apparently the police did not deem your complaint as too important. Moreover, the landlord just may revoke the offer to move without penalty and counterclaim against you. This is a situation where you probably just need to consider moving out, and moving on. Many people who post here do not have the luxury of a landlord willing to let them go, and often we respond by telling them they the landlord can enforce the lease.
