Rent Payment

My son rooms with 3 other people with rent split evenly among them. One person is out of work and his portion of the rent is being paid by another roommate. If they write a note stating his rent is being paid by the other roommate and that it will be paid back by a certain date, they both sign it, have it witnessed and notorized and the rent is not paid can the one that paid the rent take the other to small claims to get their money back?

Yes. He could do it without a signed contract as well as long as the other roommate agreed.
