Can Resident be Evicted for Loitering

I reside in low income housing apartments funded by HUD. The property manager says that if the residents are caught sitting in the breezeways, we are loitering and will be given a 30 day vacate notice. Can she legally do this???

I didn't know that residents could loiter where they live.

The properties have no patios or balconies for residents to sit. The playground area is unacceptable and seating there could not accommodate half of the residents that like to sit outside. She has told us to go to the nearest park, which is not on the busline and a 45 minute walk for an adult. What are our options to resolve the problem?

You need to look to the terms of the lease. Most leases allow eviction for illegal activity, which would include loitering, but sometimes they require a conviction or no contest plea. Whether or not the tenants are loitering is a separate issue.
