roach infestation

i rented a property which i later discovered was severly infested with roaches. i paid out of pocket for bug services.they informed me unless my landlord had the entire community sprayed it was pointless. my landlord ignored the prob.i gave 45 days notice, paid rent every month, gave them an extra mth rent and let them keep my deposits. now their taking me to court for breaking the lease. i followed the contract rules. do they have a chance of winning?i have all orkin documents and a copy of my lease termination letter. and about 25 pictures of 100s of disgusting roaches. i also just had a baby and in no way was i gonna stay there

Predicting the outcome of litigation in a court, especially in magistrate (small claims) court is very hard. However, assuming your landlord was responsible for pest control, it was not caused by you or anyone in your apartment, you properly notified your landlord of the problem, and your landlord failed to fix the problem within a reasonable amount of time, it sounds like you have a solid case to have terminated your lease and may have a good claim against the apartments.
