Legal Question in Landlord & Tenant Law in Georgia

Room mate late with rent

My girlfriend, Myself, and a Room mate, all signed a lease on an appatment in december, with a verbal agreement between us that each of us would be responsible for 1/3 of the rent and utilities. However, my room mate is 2 months late on her share of the rent and utilities, and im tired of having to cover for her just to make sure my credit is not affected and i still have a roof over my head. Is there a way i can have her evicted for being 2 months late on the rent? There is also really no sign that any payment will arrive in the near future.

Re: Room mate late with rent

You cannot evict her because you are not the landlord. And I assume that you all are jointly and severally for the rent, which means that the landlord can evict if the full rent is not paid regardless of the verbal agreement between the three of you. Separately, you might have a claim for breach of contract if your roommate is not paying their share of rent on time.
