Legal Question in Landlord & Tenant Law in Georgia

Signing to get my name off the lease

I went to the apt. leasing office and signed a paper removing my name off the lease. Now they tell me I am liable because the other name on the lease did not sign to agree to my name being taken off. They did not tell me at the time the other tenant had to sign also. I called at least 2 times and went by the leasing office once and asked if there is anything else I need to do. I was told no. Now they are threatening to file something holding me liable. I think it was called a disposery, but I'm not sure. The other tenant left the apt. without paying rent and left it in a mess. I signed to remove my name 1 month before she left and didn't pay. And I responsible?

Re: Signing to get my name off the lease

Whether you are still responsible for the rent depends on the language of the lease and the additional agreement that you signed to take your name off the lease. I would have to see them to give you a definitive answer.

What they are threatening is a dispossessory action, which is basically an eviction. If the proceed with the dispossessory action, you should receive a copy of the form complaint and you would then have a week to answer. Then a hearing would be scheduled in a week or so and you could state your case then.
