Legal Question in Landlord & Tenant Law in Georgia
My sister and I are the names on a lease for an apartment in Georgia. I moved out and I live in Alabama, and she is still in the apartment. Since I left, she offered my room to one of her friends who was homeless a place to stay and pay 1/3 rent and utilities. Okay fine. Now the roommate is kicking and abusing my animals that are in the apartment, showing complete disregard of my sisters furniture and other stuff and it not easy to get along with. My sister gave him six days to move out. He is not on the lease at all. He has no mail there. And he has paid in cash for rent without receipt. Since I am the primary leaseholder. Can I call the sheriff and apartment complex and legally kick him out when the six days are up?

You and your sister have created a mess. Depending on the terms of your lease (which normally prohibit what you did), if you try to file an eviction, call the Sheriff (who likely won't do anything), or do anything else, you and your sister might find you are all evicted and sued for damages or the remaining rent. If you moved out why are your animals and property still in the apartment? Having made the mistakes in the first place, the best option might be for you and your sister to offer him some money to move and avoid future problems of your own. Your "friend" could easily make things very difficult for you with the landlord.
