Legal Question in Landlord & Tenant Law in Georgia
son living on property free rent, no agreement as to property. Can he be removed under trespassing law in GA. I gave him wrtten notice on May 19, 2010 he is still on property. I filled with Magistrate Court a Dispossessory, he did not show up for court. Now the day after the court hearing he files in Superior Court for an appeal which I understand he can stay in the house until court date, which could be between October 19th and November 15, 2011. Do I not have any rights in this case.

Your "rights" are to seek a dispossessory, and it looks like you are exercising those rights. If you are asking whether you can disregard the law and court proceedings, the answer is no.
