Legal Question in Landlord & Tenant Law in Georgia

Sub-leasing Information

I sub-leased my last apartment. I never signed anything to live there but my name was put on the lease (no social security number though). The person i sub-leased from is threatening to take me to court for some fines they gave her. Is there anything she can do since I never signed anything?

Re: Sub-leasing Information

If you didnt sign the lease with the apartments, they would have no standing to sue you for any damages. However, if you agreed to sub-lease the apartment from your landlord (the original tenant), you would be obligated to pay whatever you agreed to pay, regardless of whether your signature is on the master lease.

Re: Sub-leasing Information

The lack of a signature did not prevent you from receiving the benefit of your agreement (the apartment). Likewise, it will not provide an after-the-fact reason for avoiding your liability (whatever that may be).
