Legal Question in Landlord & Tenant Law in Georgia
I have two tenants who are unmarried and signed a lease together in a single family house. They both got arrested and one wants out of the lease. She is out of jail. Her boyfriend is incarcerated for an indeterminate time. He has probation violations. She wants to collect the furniture. I am told she cannot get a letter of abandonment of the property from him.
Should we go through the eviction process for him? I don't have a problem letting her out. Neither wants to and have not paid rent other than the first month. There is a pending eviction on them.
