I ordered a dress from a company who promised to have the dress back by Oct 6. She waited a few days before the 6 to call and say that the dress will not be back on the 6. She then told me she ordered another dress that I did not agree to. When I asked for a refund she would not give it to me. Do I have the right to sue?

First of all, since you posted in a category of law guru that deals with legal malpractice, none of the consumer lawyers here even saw your question.
There is no "right to a refund" in Georgia unless you have a written document that so states. If the date was important to you, you should have insisted on a written document that required performance by that date and would give you a refund if it was not ready. If you did that, you can sue. If you didn't you may be able to sue if you can prove what you ordered and they try to give you something else (again it depends on the written evidence).
If it's all oral, you might sue, but how do you plan to prove your case (and you must prove it).
