my wife ate food from a restuarant and found a roach in cup took the food back and they refunded us she got sick (vomiting ) are those grounds for a lawsuit

Of course not!

If you had pursued this as a consumer matter and talked with the manager in a less confrontational way than talking lawsuit, they probably would have not only comped you one meal, but probably would have given you a coupon for your next meal.
