My attorney lost evidence important to my medical malpractice case
I have had a pending malpractice suit since 1999. My attorney has informed me that he can't find my x-rays that are a crucial part to my case. He knew that many of them were originals and was supposed to make copies of them for sfekeeping. Now I find that he does not have them and that since he has neglected my case for so long; I cannot find the films that i needed for my case at any of the clinics. He has not been communicating with me and since the case is still on the docket; it is possible that I cannot win without them. He sent the opposing attorney(who he said was a friend of his) copies of all of our information which included the films but when my attorney asked the opposing attorney for copies of the films we sent; well of course, he said he did not have them. Can I sue my attorney for legal malpractice? And to what amount of compensation? My case was against a doctor who caused me to become diabled by performing a scoliosis surgery that he messed up on and now I have had to undergo 4 more major revision spinal surgeries to correct it. He aligned my spine wrong which caused me to be bent over and not able to raise my body up and walk or stand upright. Just recently when the expert wanted them, he couldnt produce them.

Your case is apparently not over, so you do not know whether any arror has harmed you. You cannot file a suit for what may happen in the future.
