Legal Question in Medical Malpractice in Georgia
My 3 year old has had strep throat for over a month- we have been on approx 5 antibiotics from this and had a tonsillectomy per the ENT's advice. Before surgery she had begun to run a fever. I questioned the go ahead of surgery but I was assured it was nothing. Two week prior we were at a children urgent care center with severe stomach pains and massive diarrhea. Because she has been on so many meds I asked the DR if it could be antibiotic induced c-diff colitis and I was told no, it was just a virus and we were sent home. I also brought this us to the ENT and was told no. Keep in mind at this point no tests have been ran. After her surgery she spiked a 105.5 temp and landed us back in the ER. Here thy gave us fluids and yet another antibiotic. By the next day the diarrhea was back and she couldnt hold her head up. We went back to ER and she was diagnosed with c diff. We were then transferred by ambulance to a childrens hospital and have been here for three days so far. My question is can I hold any of these physicians liable?

Medical malpractice is based on a breach of the standard of care, not merely on negative results. No one here can second guess the medical professionals, as it involves a review by another qualified medical professional who reviews all the medical records.
