Damage as a result of an injection

In Nov, I saw an ortho Dr for pain in my R thumb area. He diagnosed tendon strain, and gave me an injection of cortozone. After the injection, the pain increased, and I experienced numbness in my thumb. The Dr told me that was due to an increase fluid volume in my thumb. After a month of PT and increasing pain, I saw another ortho for a second opinion. A conductivity test showed nerve damage. A resulting surgery was performed,15 Apr 03, where the 2nd Dr found that the nerve had been practically severed from the injection. The nerve had to be removed, and I will have a permanent loss of feeling there. Can I recover damages from Dr. #1 for surgery expenses, time off work, etc.?

You will first have to obtain an affidavit from another doc (preferrably another ortho. Your 2nd doc will do, if he's willing) that No. 1 violated the standard of care. You should consult with an attorney; med mal cases have to be handled very carefully.

Assuming a doctor will testify that Doctor #1 breached the standard of care, which on first glance it appears he did, then you may have a case.
